Terms and conditions

1. Who we are
GrachtAlert.nl (hereinafter: “GrachtAlert”, “we”) operates the website grachtalert.nl, the GrachtAlert mobile app and the associated API. You can reach us at d@rcey.nl. Chamber of Commerce (KvK) number: 59152923.
2. Scope
These terms apply to every use of GrachtAlert, both the free service and the paid Pro and Fleet Management (“Vlootbeheer”) subscriptions. By creating an account or starting a subscription you accept these terms. Deviating terms of a customer do not apply unless we have agreed to them in writing.
3. Account
You need an account for reporting, route features and subscriptions. You are responsible for keeping your login details confidential and for everything that happens under your account. Provide accurate details and keep them up to date. We may suspend or close accounts that are used for abuse, fraud, deliberately false reports or attempts to circumvent access restrictions.
4. Plans, trial and prices
The free plan stays free. The paid plans are subscriptions that are billed in advance, either monthly or yearly. Current prices (excluding 21% VAT; VAT is added at checkout):
- Pro: € 4,45 per month, or € 2,45 per month when paying yearly (€ 29,40 per year).
- Fleet Management: € 99,95 per month, or € 69,95 per month when paying yearly (€ 839,40 per year).
Both paid plans start with a free trial of 14 days. No payment is taken during the trial; the subscription only starts, and payment is only charged, once you actively complete checkout. If you do not subscribe, the account simply continues on the free plan (Pro) or is locked until a payment method is added (Fleet Management). We may change prices; changes apply from the next billing period and we will notify subscribers at least 30 days in advance.
5. Payment
Payments are processed by Stripe Payments Europe Ltd. We support iDEAL, SEPA direct debit and card payments, depending on what Stripe offers at checkout. By subscribing you authorise recurring charges for each billing period. Invoices are available in your account under Billing. If a payment fails we will retry it; if it keeps failing, access to the paid features is suspended until payment succeeds.
6. Term, renewal and cancellation
A subscription runs for the chosen period (one month or one year) and renews automatically. You can cancel at any time through the customer portal in your account (Billing → Manage subscription); cancellation takes effect at the end of the current period and you keep access until then.
Consumers: after the first period a yearly subscription continues for an indefinite period and can be cancelled monthly, in which case we refund the unused part of a prepaid year pro rata. Business customers: a subscription renews for the same period; there is no refund for the remainder of a period that has already started.
7. Right of withdrawal (consumers)
As a consumer you may withdraw from a paid subscription within 14 days of the first payment without giving a reason, by emailing d@rcey.nl or cancelling in the customer portal. Because the service starts immediately after checkout, you owe a proportional amount for the days already used; the remainder is refunded within 14 days to the original payment method.
8. Use of the service and navigation disclaimer
GrachtAlert is an aid. Routes, bridge and lock times, water levels, congestion, predictions and voice guidance are compiled from public sources, AIS data and user reports, and may be incomplete, outdated or wrong. The skipper always remains responsible for safe navigation, complying with the applicable regulations (including the BPR and local rules) and for verifying clearances, closures and traffic on the spot. Do not operate the app while it distracts you from steering.
Fair use applies to the API and to automated access. You may not resell, scrape or redistribute our data without written permission, submit false reports, or interfere with the operation or security of the service.
9. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may change, add or remove features, and we will announce substantial reductions of paid features in advance. Maintenance may cause temporary downtime.
10. Intellectual property and your content
The software, maps, design and data compilations of GrachtAlert are protected by intellectual property rights and remain ours or our licensors’. Reports, boat details and other content you submit remain yours; you grant us a licence to use them to operate and improve the service and to forward reports to the City of Amsterdam and other authorities as described in our privacy policy.
11. Liability
To the extent permitted by law, our liability for damage arising from the use of GrachtAlert is limited to the amount you paid to us in the twelve months preceding the event. We are not liable for indirect damage, lost profit, damage to vessels or damage resulting from navigation decisions made on the basis of information in the service. Nothing in these terms limits liability for intent or gross negligence or the statutory rights of consumers.

How we handle personal data is described in our privacy policy.
13. Changes to these terms and applicable law
We may amend these terms. The current version is always on this page with the date of the last change; material changes for subscribers are announced by e-mail in advance. Dutch law applies. Disputes are submitted to the competent court in Amsterdam; consumers may also use the EU online dispute resolution platform or choose the court that is competent under the law.
